Terms & Conditions

Apparel Subscription Rental Agreement

These terms and conditions are a legal agreement between you (hereinafter referred to as "Customer") and Edunetwork Private Limited (hereinafter referred to as "Rentomojo"), establishing terms and conditions under which the Customer will submit information to, and rent apparel (each a "Product" and collectively, "Products") and receive related services ( "Services") from Rentomojo on monthly subscription basis.

CAREFULLY READ THE TERMS AND CONDITIONS OF THIS AGREEMENT. BY ORDERING PRODUCTS OFFERED ON OUR SITE, SIGNING UP FOR THE SERVICE, YOU ARE AGREEING TO BE BOUND BY AND ARE BECOMING A PARTY TO THIS AGREEMENT. IF YOU DO NOT AGREE TO ALL OF THE TERMS OF THIS AGREEMENT, PLEASE DO NOT ORDER ANY PRODUCTS.

1. SUBSCRIPTION

The Customer shall be entitled to rent up to 20 (Twenty) Products from Rentomojo, as part of its monthly subscription plan. The Customer shall receive the first box with the set of 10 Products for 15 days and second box with the set of remaining 10 Products after 15 days from the delivery of the first box. Rentomojo reserves the right to increase or decrease the number of Products that can be rented by the Customer under its monthly subscription plan. Any amendment to the subscription plan shall not affect any ongoing subscription plan of the Customer.

2. SUBSCRIPTION FEES & DEPOSIT

For availing the subscription of Products, the Customer shall pay the subscription fee ( "Subscription box") to Rentomojo. The subscription shall be paid by the Customer in advance.

Along with the Subscription Fee, the Customer shall be liable to pay a refundable security deposit (“Security Deposit”) for the subscription of the Products. The Customer hereby agrees that the Security Deposit shall not carry any interest on the amount for the entire period. In case any damage is found in any Product, Rentomojo shall have the right to deduct the charges for the damages from the Security Deposit paid by the Customer and shall refund the remaining amount to the Customer at the end of subscription period as per the Refund Policy.

3. ORDER

On receipt of the order and the Security Deposit, Rentomojo shall confirm the order with the Customer by sending a confirmation to the registered e-mail address of the Customer.

The order raised by the Customer shall be processed subject to successful verification of the KYC and serviceability of the Customer location as per Rentomojo Policy. In case the KYC verification is not successful, or the location is not serviceable by Rentomojo, Rentomojo reserves the right to reject the Customer’s order any time prior to delivery at its sole discretion without assigning any reason.

The first set of 10 Products shall be sent to the Customer in a box (Subscription box). Rentomojo shall make the delivery to the Customer as per the Delivery Policy contained in this Agreement. The Customer shall be able to select the refresh Subscription Box for remaining 10 Products (Refresh Box), after the 10th day from the delivery of the first Subscription Box upto the 15th day. In the event, the Customer fails to select the Products for the Refresh Box by the 15th day from the date of delivery of the first Subscription Box, Rentomojo shall consider the first Subscription Box as the Refresh Box for the Customer and the Customer shall not have the right to select the remaining 10 Products for the Refresh Box for that current month.

On successful selection of the remaining 10 Products for the Refresh Box, Rentomojo shall deliver the Refresh Box only after 15 days from the date delivery of the first Subscription Box and shall pick up the first Subscription Box from the Customer. The Customer shall use the Products of the Refresh box for the period of 15 days from the delivery of the Refresh Box.

In case the customer wishes to continue the monthly subscription, subject to the payment of the advance Subscription Fee, the Customer shall be able to select the 10 Products for the next month’s first Subscription Box after the 10th day from the delivery of the Refresh Box upto the 15th day. Rentomojo shall deliver the first box for the subsequent month as per the Delivery Policy.

If the Customer does not wish to continue the monthly subscription, Rentomojo shall refund the Security Deposit paid by the Customer, subject to deductions (if any).

4. DELIVERY

The first Subscription Box shall be delivered to the Customer within 2-3 days from the date of placing the order and the Refresh Box shall be delivered after 15 days from the date of delivery of the first Subscription Box, subject to successful selection of Products for the Refresh Box. The cost of the delivery of the Subscription Box and the Refresh Box shall be borne by Rentomojo. The Customer shall be present at the location at the time of delivery agreed between Rentomojo and the Customer. If the Customer is unreachable or unavailable during the agreed delivery/pickup timings, leading to a failed delivery/pickup of the Products, the Customer will be charged Rs. 150 for any additional arrangements to deliver/pickup the Products.

5. USE OF THE PRODUCTS

Upon delivery, the Customer shall bear responsibility for the Products. Any damage to the Product or the Subscription Box, not being normal wear and tear, Rentomojo shall levy a penalty for such damage from the Customer.

The Customer hereby agrees to treat the Products with great care and return it in the same condition as delivered to the Customer. The Customer shall be liable to compensate Rentomojo for loss, destruction or damage to the Products due to theft, disappearance, fire, stains or any other cause, other than normal wear and tear. Normal wear and tear shall include opening of stitches, missing buttons, stuck zippers. In the event, any Product returned is damaged beyond the normal wear and tear, Rentomojo shall levy a penalty of Rs. 1200 towards the cost of replacing the Product.

The Products shall be fitted with a radio frequency identification (RFID) button, the Customer shall not remove the RFID from the Product under any circumstance. In the event the RFID is missing from the Product, Rentomojo shall levy a penalty of Rs. 150 on the Customer.

6. CLEANING

All Products will be professionally cleaned and delivered ready to wear for each consumer. Rentomojo shall tumble wash and / or dry clean and inspect each Product with the utmost care but use of the Product is at the Customer’s own risk and Rentomojo shall not be held liable for any health-related complaints associated with a Product rented from Rentomojo.

The Customer shall not wash or dry clean any Product, rented from Rentomojo.

7. PICK UP OF APPAREL

Rentomojo shall pick up the Subscription Box or Refresh Box at the end of 15 days from the date of delivery of the first Subscription Box or the Refresh Box (as the case may be). In the event, the Customer fails to return the first Subscription Box or the Refresh Box (as the case may be) at the end of 15 days from the date of delivery, Rentomojo shall levy a penalty of Rs. 100 per day ("Late Fee") until such day the first Subscription Box or the Refresh Box (as the case may be) is returned to Rentomojo. Rentomojo shall deduct the Late Fee from the Security Deposit paid by the Customer and refund the remaining amount to the Customer.

The Customer shall return the Products on the agreed upon date/time at the agreed upon location unless the Customer contacts Rentomojo at least 2 (two) days in advance and a mutually alternative date/time or location is agreed upon.

The Products and the first Subscription Box or the Refresh Box shall be returned in a good condition in the way the Customer had received it from Rentomojo apart from the normal use and wear and tear. The Customer shall be liable for any and all additional cost that may be incurred by Rentomojo for the upkeep of the Products (penalty as per clause 5) and the Subscription Box. Rentomojo shall levy a penalty of Rs. 200 for damage to the Subscription Box. The Customer agrees that, Rentomojo shall have the right to deduct the amount towards the penalty from the Security deposit paid by the Customer.

Rentomojo’ s representative shall have the right to inspect the Products at the time of pick up of the Subscription Box or the Refresh Box and if any damage is found to the Products, the representative shall inform the same to the Customer, however, a thorough inspection shall only be done once the Subscription Box or the Refresh Box reaches the warehouse. The inspection conducted by the Rentomojo at its warehouse shall be final and binding on the Customer.

In the event, the Customer does not wish the Rentomojo representative to conduct inspection at the premises of the Customer, the Customer shall have an option to request the representative not inspect the Products at the premises.

8. REFUND POLICY

If the Products and the Box is received from the Customer without any reports of damage other than normal wear and tear, the whole amount of the Security Deposit will be refunded to the Customer without any interest within 7-10 working days from the date of pickup of the Subscription Box or the Refresh Box. In case the Customer continues monthly subscription, the Security Deposit shall be refunded only after the end of subscription period (subject to any deduction). The business being on subscription basis, Rentomojo shall not be liable to refund the Subscription Fee paid by the Customer for any reason whatsoever.

9. OWNERSHIP OF PRODUCTS

Rentomojo or its business affiliates shall at all times during the term of this Agreement, retain title to and / or be the beneficial owners of the Products delivered to the Customer, pursuant to the Agreement. Nothing in this Agreement shall be construed as a transfer of ownership of the Products to the Customer. The Customer shall give immediate notice to Rentomojo if any of the Product is about to become liable or is threatened with seizure and the Customer shall indemnify Rentomojo against all loss and damage caused by such action against its Products.

10. ASSIGNMENT

The Customer shall not assign or transfer any interest in this Agreement or the Products without the written consent of Rentomojo. Any such transfer or assignment shall be considered as illegal and hence a violation of the terms of this Agreement. Rentomojo reserves the right to assign this Agreement, to any third party (including credit rating agencies, factoring agents and NBFC) without prior notice to the Customer.

11. INDEMNIFICATION

The Customer shall indemnify, defend and hold Rentomojo harmless from and against any claim, demand, cause of action or loss or liability (including, but not limited to, attorneys’ fees and costs) for any Product damage or personal injury arising from the Customer’s use of the Product by any cause, except to the extent such is caused by Rentomojo negligence or willful misconduct. The provisions of this clause shall survive the termination of this Agreement with respect to any claim or liability accruing before such termination. In no event shall Rentomojo be liable for any direct, indirect, special or consequential loss or damage arising out of Customer’s use of the Products.

12. GOVERNING LAW

This Agreement shall be governed by the laws of India and shall be subject to exclusive jurisdiction of courts in Bengaluru.

13. LIMITATION OF LIABILITY

Notwithstanding any other provision of this Agreement, Rentomojo’s total liability to Customer shall not exceed the total amount of 1 (one) month subscription fee received from the Customer.

14. ENTIRE AGREEMENT

This Agreement (together with the Annexure) constitutes the entire agreement between Rentomojo and the Customer. The acceptance of this Agreement also signifies the acceptance of the Customer, to the terms and conditions on the Rentomojo website. In the event of any conflict between the terms and conditions on the Rentomojo website (including privacy policy) and this Agreement, the terms and conditions on the Rentomojo website shall supersede.
